You may print copies, and make electronic copies of this data so long as the copies are used only by members of your organization physically located at the address to which the data was delivered. You may not give, trade, transfer electronically, distribute, or sell copies of this data, in part or whole, or your license rights in this data to any other party within your organization at other locations or to any other entity and you may not use this data to market any product or service other than your own or to create, add to or update any commercially sold databases. This data is intended only for the non-exclusive use of the individual or entity to which this packet was delivered and may not be used by any other party or entity. This data is owned by and reflects the original research of AS400-List.com. It is of a sensitive and confidential nature and is protected by United States copyright laws. OUR WARRANTY AND LICENSING AGREEMENT IS A LEGAL AND BINDING CONTRACT BETWEEN THE END USER, AND AS400-LIST.COM. THE END USER SHOULD CAREFULLY READ ALL THE TERMS AND CONDITIONS CONTAINED IN THIS AGREEMENT BEFORE ORDERING THEIR LIST. BY PLACING AN ORDER FOR AN AS/400 PROSPECT LIST THE USER INDICATES THEIR ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS CONTRACT.

SITE WARRANTY: Every site in our list is an individual product. AS400 List Corp warrants that the INFORMATION concerning an individual site in our Premium and Deluxe lists will be free from defect in accuracy and correctness for one year from your date of purchase. AS400-List.com also warrants that an individual site in our Premium and Deluxe lists will currently be in business and be using an IBM AS/400 computer system for up to ninety (90) days from your date of purchase. AS400 List Corp does not warrant the overall accuracy or guarantee the specific percentage of accuracy of any list. 

EMAIL ADDRESS WARRANTY: Every email address in our list is an individual product. AS400 List Corp warrants that the INFORMATION concerning an individual email address will be free from defect in accuracy and correctness and that an individual email address will be DELIVERABLE via Email for a period of up to ninety (30) days from your date of purchase. AS400-List.com also warrants that an individual email address will be the email address for an executive working for a company that is currently be in business and using an IBM AS/400 computer system for up to ninety (90) days from your date of purchase. AS400 List Corp does not warrant the overall accuracy or guarantee the specific percentage of accuracy of any list. 

REPLACEMENT: Upon the return within the specified warranty period of an individual site or email address that is inaccurate, that is no longer for a company that is in business or is no longer using an IBM AS/400 computer system, in it’s original format and field structure, freight prepaid, AS400-List.com’s entire obligation, responsibility, or liability and your exclusive remedy shall be the replacement of the inaccurate site or email address with an additional site or email address or if a replacement is not available we will refund the purchase price of that individual site or email address. You must maintain your licensing rights to the data for our warranty to be enforceable.

AUTHORIZATION TO RETURN DATA: Authorizations to return data must be obtained from AS400-List.com in advance. To obtain an RMA number simply contact us at AS400-list.com and tell us what you would like to do. All sites sent to AS400-List.com without an RMA number will be ignored. All replacements will be made as quickly as possible but AS400-List.com is under no obligation to do so within any given time frame.

WARRANTY DISCLAIMER: To the maximum extent permitted by applicable law, except as provided above, every list is provided "AS IS" without warranty of any kind. AS400-List.com does not warrant, guarantee or make any representations regarding the use of or the results obtained with this list. The above is the only warranty of any kind, either express or implied, that is made by AS400-List.com including without limitation, any warranty of merchantability, fitness for a particular purpose, or any warranty arising out of any proposal, specification or sample.

LIMITATIONS OF LIABILITY: To the maximum extent permitted by applicable law, neither AS400-List.com nor its vendors shall be liable for any direct, speculative, consequential, incidental and special damages hereunder including, without limitation, damages due to lost profits, use of data, loss of use or anticipated loss of use of the data, or the inability to use the data, whether arising out of contract, negligence, tort or under any warranty, even if advised of the possibility of such damages. In no event shall AS400-List.com liability for damages exceed the amount paid for the list. AS400-List.com neither assumes nor authorizes anyone to assume for it any other liabilities.

COMPLIANCE: Failure to comply with the above license agreement shall constitute a breach of contract, in which case, you will forfeit your license rights in this data, you will no longer have the right to use this data in any form, the data must be returned immediately to AS400-List.com and you will be subject to possible civil and criminal liabilities.

DISPUTES: In the event a dispute shall arise between the parties to any aspect of this contract and performance of any term under this contract, the parties agree to participate in at least four hours of mediation in accordance with the mediation procedures of United States Arbitration & Mediation. The parties agree to share equally in the costs of the mediation. The mediation shall be administered by USA & M Pennsylvania, 3637 Markham Dr, Bensalem, PA 19020 (800-354-2478).

If the dispute or difference is not settled within 30 days of the submission to mediation (unless such period is extended by agreement of the parties), it shall be and is hereby submitted to arbitration in accordance with, and subject to, United States Arbitration and Mediation Rules of Arbitration. The parties agree to share equally in the costs of the Arbitration. The arbitration shall be administered by USA & M Pennsylvania, 3637 Markham Dr, Bensalem, PA 19020 (800-354-2478). The arbitrator's decision shall be final and binding and judgment may be entered thereon.

In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator's award, or fails to comply with arbitrator's award, the other party is entitled of costs of mediation and arbitration including a reasonable attorney's fee for having to compel arbitration or defend or enforce the award.

Mailing lists are supposed to make you money but they have to be accurate and current for this to happen. In fact, if you don’t get an up-to-date list for your mailing it may end up costing you money instead of making you money! Having the most up-to-date list is vital to keeping your advertising expenses down and with the high cost of postage, mailing to a stale or inaccurate list can be an expensive and fruitless investment.

The gathering of new AS400 sales leads and the updating of existing sales leads is a never ending and extremely time consuming process but we do our best to keep our prospect list as accurate as possible. We cross-reference our database with the Post Office's "national change of address" database to update our addresses. We have our database cross-referenced against every company, address and phone number in the United States once a year to verify that each company is at the address and phone numbers listed. We update records from information sent in by our clients. We delete any inaccurate leads sent back to us from our clients. We do all of this to insure that you get the best possible AS400 prospect list at the best possible price!

While some pieces of information such as the company names don't change very often and are fairly easy to keep current, some items such as the contact names, change very often. Data processing people are very dynamic and typically change jobs every 18 months. This means that of the 250,000 contacts that we try to keep tabs on at least 5,000 or more change jobs every month! You could call a company today and talk to the DP Manager then call him back next month and discover that he no longer works there! As you can see, updating the names of the people working at a company is the most difficult challenge we face.

As mentioned above accuracy is very important to us and we have attempted to walk a fine line between accuracy and price. Unfortunately, every list contains a certain percentage of errors, some more than others. The actual percentage of sites "that you can't use" in any list you get will vary depending upon your specific list selections.

There are several lists out there in all kinds of price ranges. We have purchased from them all and they are all contain errors, even the most expensive ones and most often you get absolutely no guarantee of accuracy. Although our list contains errors you don't have to pay for any of our mistakes! No one else does that! You also get to keep and use any sites that have errors, and just because some contact name might be out of date it doesn't prevent you from making a sale to that company!

AS400-List.com has the, most generous warrant agreement in the industry. We believe that if you pay for 1,000 sites then you should get 1,000 accurate sites! If any of the sites that we send you are not completely accurate we will replace these sites with an equal number of sites at no added expense to you. We will do this for as long as you like. With this kind of warranty you could conceivably call on a company today, in which all of the information is perfect and with which you might do considerable business and six months from now the company changes their address, their phone number, hires a new MIS Director, buys a new computer or goes out of business, and we will still honor our warranty and replace that site.

Authorization to return any data must be obtained from AS400-List.com in advance. If you wish to return any defective data to AS400-List.com you must obtain an RMA number. To obtain an RMA number simply contact us at AS400-list.com and tell us what you would like to do. All packages sent to AS400-List.com without an RMA number will be sent back.

Here are some important guidelines for returning data to AS400-List.com. The closer you follow these guidelines the easier it will be for us to process your returned data and the quicker you will get your new sites. All returned records should be in the same file structure sent to you by AS400-List.com including the "record number" field and the field with changes or error codes. All returned records that you consider to be duplicate records must clearly be the same company at the same address in the same city and must include the "record number" of the record it duplicates in the "changes" field. Because our warranty is so generous, we ask for your indulgence in processing your returned data. AS400-List.com will process all returns based on how closely the above guidelines are followed. The processing of returned data could typically take 2-4 weeks from the time your data is received by AS400-List.com depending upon how well the guidelines were followed.

AS400-List.com reserves the right to replace returned sites with additional records as stated in our warranty and licensing agreement. Additional records may also include any sites that were returned by you that we are able to correct.
